FREQUENTLY ASKED QUESTIONS
If you or a loved one has been injured, you will have many questions. Here are a few of the questions we are most commonly asked.
Q. Why should I hire an attorney?
A. You should contact our law office if you believe that your injuries or those of your loved one resulted from negligence. By negligence, we mean someone's violation of the standards and norms they are required to uphold and which resulted in harm to you or your loved one. In many cases, those who hire a personal injury attorney receive higher settlements after paying costs and attorney fees than those who try to resolve their cases on their own. The interest of insurance companies is to provide you with the smallest amount of compensation possible, if any at all. Insurance companies can get away with this unless you have an experienced attorney who will aggressively fight to get the full amount of compensation that you deserve.
Q. What is negligence?
A. Negligence is a failure to take reasonable care to avoid causing injury or loss to another person. There are four elements of negligence that an injured person must prove in order to win a personal injury case:
-
The defendant owed a legal duty to the plaintiff under the circumstances (for example, a doctor owes a patient a legal duty to provide proper medical care, or a driver owes other drivers a legal duty to operate their vehicle with care).
-
The defendant breached the legal duty by acting or failing to act in a certain way (the defendant is held to the standard of how a reasonably prudent person would act under the same circumstances).
-
It was the defendant’s actions, or lack of actions, that caused the injury.
-
The plaintiff was harmed or injured as a result of the defendant’s actions.
Q. I have been injured and want to make a claim for my injury. How do I do this?
A. Write down as much information as you can concerning the event that caused your injury. This may include the names of the people involved including possible witnesses. Write down everything you were told by witnesses and by the person who may have caused the accident. If possible, preserve any evidence.
Q. I have been injured and need medical attention right now. How can I get it?
A. There are several ways to pay for medical care after an accident. Call our office for guidance and help concerning this and the other subjects of immediate concern for the injury victim and their family.
